Family Law

When you are married and then separate, there are five causes of action that need to be addressed.  These causes of action can be resolved by a separation and property settlement agreement or by litigation.  The causes of action include: equitable distribution, child custody, child support, post separation support and alimony.  Once you have been separated more than one year, then you are eligible for divorce.    But, family law also includes preparing for marriage by prenuptial and postnuptial agreements. We provide individualized advice to each client on planning choices, assisting them with implementing their personal plans and preparing the appropriate legal documents, including wills, different types of trust agreements, powers of attorney, and other planning documents. We also advise executors and trustees about their fiduciary duties to properly administer estates and trusts.

Appellate Practice

As an extension of our family law and litigation practice, Candler Law Group is devoted to serving clients in their post-trial appeals before the North Carolina Court of Appeals and North Carolina Supreme Court.  Our experience includes representing appellants (those who disagreed with the trial court’s decision) and appellees (the party that prevailed in the trial court, but must defend that outcome on appeal).

Our appellate litigators understand the decision-making process of appellate judges and possess the skills of intense legal research and occasionally oral advocacy that is necessary in these courts. We also have the necessary attention to detail, knowledge of the Rules of Appellate Procedure, and strong research and writing skills, which enhance the opportunity for success at the appellate level. Prior to entering into private practice, Emily Sutton Dezio clerked for North Carolina Supreme Court Justice Bob Orr.  It is through this experience that she has learned how to correct errors from trial courts.
